INTRODUCTION
Any capitalized but undefined terms herein are defined in the ASW Distillery Terms of Service. The Sites are provided by ASW Distillery, LLC, a Georgia limited liability company and/or its affiliates (“ASW Distillery”, “we”, or “us”). ASW Distillery includes, without limitation, businesses operated under the following brand names: Ameireaganach Single Malt, American Spirit Whiskey, Armour & Oak Apple Brandy, Duality Double Malt, Fiddler Bourbon, Resurgens Rye, The Craic Whiskey, and Tire Fire Single Malt Whiskey.
The goal of this Privacy Policy is to inform you about the information we gather about you, how we use and share that information, and how we safeguard that information; it contains mentions of the few instances where personally-identifiable information is used. Typically, this is limited to an email address that you voluntarily elect to provide us to receive notifications of ASW Distillery updates.

Your use of any of the Sites are subject to this Privacy Policy as well as our Terms of Use. By using any of the Sites, you also certify that you are of legal age to purchase alcohol in your country of residence (“Legal Age”).
If you are not of Legal Age or do not accept this Privacy Policy in its entirety, please leave all of the Sites immediately. Do not provide us with your personal information if you are not of Legal Age. If we believe you are under the Legal Age, we will make every reasonable effort to remove your personal information from our records.

COLLECTION OF YOUR INFORMATION
Information You Provide to Us
We collect personal information from you when you interact with us via this Site. Personal information is information that identifies you or is reasonably linked to you. The personal information we may collect includes your name, email address, mailing address, shipping address, phone number, and/or credit or debit payment card information. Creating a personal account on any of the Sites;

We also may collect information about you from service providers and other third parties (“Third Party Service Providers”), a non-exhaustive list of which we provide below. Automated Information Collection
We may receive and store certain types of technological information when you interact with any of our Sites, our emails, and our online advertisements. This information is intended to help our Sites work properly, to help us evaluate use of our Sites, and to support our website analytics and marketing campaigns. ASW Distillery may participate in interest-based advertising. ASW Distillery uses your information to offer and provide our products and services and to support our core business functions. These include order or service fulfillment, internal business processes, tailored promotional offers and rewards, marketing, authentication, loss and fraud prevention, public safety and legal functions. - To respond to and fulfil your requests for products and services and communicate with you about those requests;
- To register and service your account;
- To administer surveys, sweepstakes, contests, and promotions;
- To provide customer service and alert you to product information, including recalls;

ASW Distillery may share your personal information with service providers and other third parties (“Third Party Service Providers”) who need access to your information to provide operational or other support services, such as direct mail vendors, shipping service providers, and other companies that help us improve our product and service offers and our Sites. In addition, unless otherwise disclosed to you, our service providers are not authorized to use or disclose your personal information for their own marketing purposes.

ASW Distillery may transfer any information we have about you in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of ASW Distillery or as part of a corporate reorganization or stock sale or other change in corporate control.
Aggregate Information with Third Parties:
We may share aggregate information (i.e., information that does not directly identify an individual) with third parties for lawful purposes.
YOUR CHOICES
If you would like to opt out of our promotional emails, please follow the unsubscribe link at the bottom of each such email.
If you would like to opt out of receiving direct mail from us, please do so by emailing info@aswdistillery.com.
If you would like to change or delete your account information from the Site, please do so by emailing info@aswdistillery.com. Please provide us the website with your account information and instructions on the information that you want changed or deleted and we will take every effort to ensure the deletion or modification of all information you instruct us to change or delete.
Please be sure to include your full name, phone number, email address, the types of communications you would like to receive or not receive, and all relevant contact information in any communication you send to us. For example, if you would like to opt-out of receiving direct mail, please make sure to include your mailing address in your communication to us.
Please allow a reasonable time for your preferences to be processed. It may take up to 10 days to process your requests related to email and up to 30 days to process other requests.
Please be aware that, even if you opt out of receiving marketing communications from us, we may still contact you for transactional purposes such as customer service, service notices, or recalls.
As described above, ASW Distillery participates in online interest-based advertising. Please note that the NAI opt-out mechanism relies on cookies to remember your choices with respect to ad-serving on websites. If you delete your cookies, use another computer or device, or change browsers, you will need to repeat the opt-out process. If you do opt-out of interest-based advertisements, you may still see advertisements on websites you visit, but those ads will not be based on your browsing behavior.
Our mobile services may use location information transmitted by your mobile device. You can adjust the settings of your mobile device at any time to control whether your device communicates this location information. Please see your device instructions to learn more about these settings.
OUR COOKIES
Most web browsers allow you to exercise control over cookie files on your computer by erasing them, blocking them, or notifying you when such a file is stored. We endeavor to maintain reasonable and appropriate physical, administrative, and technical controls to protect your personal information.
For Site users based in the European Union (EU), we will provide notification within seventy two (72) hours of becoming aware of any data breach of any of our systems or Third Party Service Providers, consistent with Article 33 of the European Union General Data Protection Regulation (“GDPR”). MOBILE APPLICATIONS AND SERVICES (INCLUDING WI-FI)
For any ASW Distillery mobile applications, such mobile applications and services may collect certain information automatically, such as the type of mobile device you use, the temporary or persistent unique device identifiers (UDIDs) placed by us or our service providers, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use our mobile applications and services.
Our mobile applications and services may also collect precise information about the location of your device through your device before our mobile applications and services obtain such location information from technologies like GPS, Wi-Fi, or cell tower proximity (or a combination of these technologies). For non-EU Site users, ASW Distillery and our Third Party Service Providers may use and store this information, in combination with other location-based information such as IP address and billing or postal code provided by you at time of your mobile application registration, to provide enhanced location based services, such as search results and other content.
Users of our mobile applications and services may use the following mechanisms to opt-out of the collection and use of your precise location information:
You can stop all collection of information by our mobile applications by uninstalling the mobile application. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network. If you uninstall a mobile application from your device, the ASW Distillery unique identifier associated with your device may continue to be stored. If you re-install the application on the same device, ASW Distillery will be able to re-associate this identifier to your previous transactions.
You may at any time opt-out from further allowing us to have access to your location data by adjusting the permissions on your mobile device.
INTERNATIONAL
This Site is controlled and operated by us from the United States and is not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your personal information may be stored and processed in the United States or any other country in which ASW Distillery or its Third Party Service Providers maintain facilities. By using this Site, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than in your country.
CALIFORNIA PRIVACY RIGHTS
If you are a California resident and ASW Distillery customer, you can request a notice disclosing the categories of information we have shared with third parties for the third parties’ direct marketing purposes during the preceding calendar year.
